  1. Application of General Terms and Conditions

1.1 Juicy Lucy sells cold pressed juices & mylks, through the private company Pura Vida Ecom BV, with registered office at 3920 Lommel, Ruiterijstraat 36, VAT BE0738497028. These general terms and conditions apply to activities via the webshop.


1.2 By placing an order, the customer acknowledges having read these general terms and conditions and accepts that they shall apply to all existing and future legal relationships with Juicy Lucy.


1.3 These general terms and conditions always take precedence over any terms and conditions of the customer, which are not opposable to Juicy Lucy, even if they stipulate that they are the only ones.


1.4 Any deviation from these general terms and conditions must be the subject of a written confirmation between Juicy Lucy and the customer. Such deviation is only valid for the specific agreed case and can never be considered as a precedent.


1.5 Juicy Lucy's failure to exercise any right, even when she does it repeatedly, can only be interpreted as tolerating a circumstance and does not imply legal action.


1.6 Juicy Lucy reserves the right to amend or change its general terms and conditions at any time.


1.7 The possible nullity of one or more clauses of these general terms and conditions or part thereof, does not affect the validity and applicability of the other clauses and/or the rest of the provision in question. In the event of nullity of one of the clauses, Juicy Lucy and the customer will negotiate to replace the null and void clause with an equivalent clause that complies with the spirit of the general terms and conditions. If Juicy Lucy and the customer do not reach an agreement about this, the competent court may moderate the void provision to what is (legally) allowed.


  1. Realization of the agreement

2.1 When ordering Juicy Lucy juices online at www.juicy-lucy.be, all steps of the ordering process must be completed.


2.2 A web shop order must be paid online in accordance with the provisions of article 7.


  1. Execution of the agreement

3.1 Juicy Lucy is only bound to deliver the products and/or perform the services as specifically described in the order confirmation or the other documents that are part of the agreement.


3.2 All products and services that were not explicitly foreseen will be charged to the customer on a supplementary basis, regardless of whether they are the result of a change in the order by the customer, unforeseen circumstances or any other reason.


  1. Cancellation agreement

For the online purchases of Juicy Lucy cold pressed juices via www.juicy-lucy.be, the customer-consumer does not have a right of withdrawal in accordance with the provisions of Book VI of the Belgian Economic Code, since these purchases relate to the delivery of goods that have a limited shelf life and are liable to deteriorate rapidly (Article VI.53, 4° of the Belgian Economic Code).


  1. Delivery by Juicy Lucy

5.1 Deliveries are made by Juicy Lucy or its logistics partner to the delivery address indicated by the customer.


5.2 Deliveries of orders from the webshop are made by default via Bpost (excluding holidays and bridges) on Tuesday, Wednesday, Thursday or Friday. The standard shipping is subject to the service of Bpost, therefore Juicy Lucy can only specify the delivery day. 


5.3 A minimum purchase of products worth € 29,95 (plus €5,95-€15,95 standard shipping with bpost) is applied.


5.4 In case of an order above € 45 and a standard shipment with bpost, no delivery costs are charged to the customer (otherwise € 10 is added to the total).


5.5 In case the logistics partner / Juicy Lucy presents itself for delivery during that agreed time slot, but the goods are not accepted by the customer, then the goods are deemed to have been received by the customer without any formal notice and will not be presented for delivery again. The customer will be obliged to collect them, if applicable. Under no circumstances shall the customer be entitled to any reduction or refund of the price.


5.6 Juicy Lucy is not liable if the delivery is left unattended at the agreed delivery address (e.g. at the door) on the instruction of the customer.


5.7 Late or non-delivery due to force majeure or hardship on the part of Juicy Lucy shall not give rise to any liability on the part of Juicy Lucy to the customer.


  1. Price

6.1 All product prices are in euros and include VAT. Additional costs, such as delivery costs, are always mentioned separately.


6.2 Juicy Lucy reserves the right to adjust prices at any time. The price due by the customer is the price as shown on the order confirmation.


  1. Payment

7.1 Online orders through Juicy Lucy's webshop must be paid for immediately through the offered online payment instruments.


For online payments, Juicy Lucy relies on external professional and specialized partners that operate a payment platform. The customer's financial data entered within the framework of an online payment are exchanged only between the external partner and the financial institutions concerned. Juicy Lucy has no access to the customer's confidential financial data. Online payments are made using secure protocols. All online payments are subject to the general terms and conditions of the external payment platform operator, which bears sole responsibility with regard to the correct execution of all online payments.


7.2 Unless explicitly agreed otherwise, Juicy Lucy is not obliged to deliver or execute as long as the online order has not been paid for in full.


7.3 Professional customers placing orders for professional use may request an invoice after the order has been processed.the invoice should be requested by sending an email to hello@juicy-lucy.be


  1. Complaints

8.1 Juicy Lucy guarantees the quality and freshness of its products during the indicated period of use, provided that the customer keeps the products in their unopened packaging and in adequate conditions (including refrigeration).


8.2 The customer is required to verify the juices after delivery, among other things (but not exclusively) with regard to conformity, correct quantities, visible defects, late delivery, etc. Complaints regarding Juicy Lucy juices are only taken into consideration if the customer has mentioned them on the signed delivery note or, in the absence of a delivery note, if they are communicated to Juicy Lucy in writing or electronically within a period of two (2) hours after the products have been delivered or after the agreed time of delivery. After the discovery of any defect, the customer is obliged to immediately cease using the products in question.


8.3 In any case, complaints must always be submitted to Juicy Lucy in writing or electronically, with identification of the goods/services involved and a detailed justification of the complaint. In the absence of a timely written complaint, the customer shall be deemed to irrevocably accept the goods and services delivered.


8.4 After the discovery of any shortcoming or alleged defect, the customer is obliged to do and to have done everything reasonably possible to prevent (further) damage.


8.5 The customer is obliged to reimburse the costs incurred as a result of unjustified complaints.


  1. Liability

9.1 Juicy Lucy's liability is in any case limited - at Juicy Lucy's own discretion - to the (re)delivery of the missing or defective products. If redelivery/re-execution is not (any longer) possible or meaningful, the customer is entitled to a refund of the price of the missing or defective products and/or services.


9.2 In any case, Juicy Lucy's liability shall never exceed the invoice value of the missing or defective products or services. Juicy Lucy's liability is limited to the liability that is mandatorily imposed by law.


9.3 In no case shall the Customer be entitled to indemnification by Juicy Lucy for:


(i) Defects caused directly or indirectly by an act of the customer or a third party, whether caused by error, negligence or carelessness;


(ii) Problems with the freshness or quality of products due to:


     (a) Consumption after the indicated expiration date or normal consumption period of the products;


     (b) Storage in inappropriate conditions (including refrigeration, humidity or external odors), in inappropriate packaging or after opening the packaging;


(iii) Additional damage caused by further use or application by the customer after the determination of a defect;


(iv) Alleged defects based on subjective data, such as personal taste or preferences;


(v) Allergic or other reactions resulting from the consumption of the products;


(vi) Claims related to the failure to achieve certain objectives in terms of diet, health or mentality. Juicy Lucy in no way guarantees that the customer will or can achieve such objectives;


(vii) Damages that would not have occurred if the customer had acted with sufficient diligence to mitigate the damage;


(viii) Damages caused by force majeure or hardship, in accordance with the provisions of Article 12;


(ix) Indirect and consequential damage, such as, but not limited to, damage to image, loss of income, loss of turnover, damage to third parties, etc.


  1. Force Majeure & Hardship

10.1 Juicy Lucy and the client are not liable for any failure to perform their obligations caused by force majeure or hardship.


10.2 Cases of force majeure or hardship shall entitle Juicy Lucy, at its option:


(i) To temporarily suspend the performance of its own obligations;


(ii) Revise the contractual terms;


(iii) Terminate the contract by simple written notice to the customer, without Juicy Lucy being or being liable to pay any compensation.


In all these cases, the customer will be obliged to pay for all products and services already delivered on the date of suspension, revision or termination, and for all costs incurred or to be incurred by Juicy Lucy as a result of the suspension, revision or termination.


10.3 Are conventionally considered as cases of force majeure or hardship: all circumstances which at the time of the conclusion of the agreement were reasonably unforeseeable and unavoidable and which create the impossibility to execute the agreement or which would make the execution of the agreement financially or otherwise more burdensome or difficult than normally foreseen, such as, for example (not limited to) natural circumstances, war, terrorism or the threat of terrorism, strikes, lock-outs, illnesses, staff shortages, company organisational circumstances, seizure, fire, breakage of machinery and/or tools, scarcity of raw materials and/or materials, delays in or bankruptcy of suppliers or subcontractors.


  1. Competent courts & Applicable law

11.1 In the event of any dispute regarding these general terms and conditions, as well as any other agreement entered into between Juicy Lucy and the customer, the territorially competent courts and tribunals of Juicy Lucy's registered office shall have sole jurisdiction.


11.2 Belgian law shall apply.
